Geographical Indications in India

How a name tied to a place became a legal right, who holds it, what it has done for weavers and farmers, and where the disputes are. Counts are as on 31 December 2025.

684GI entries, as on 31 December 2025[1]
30states and union territories with entries of their own

78entries for Uttar Pradesh, the most of any state

What a geographical indication is

A GI identifies goods as coming from a particular country, region or locality, where a given quality, reputation or other characteristic of the goods is essentially due to that origin.

Indian law covers agricultural, natural and manufactured goods. The name does not have to be a place name. The TRIPS definition lets a non-geographical name qualify if it points to goods from a particular territory. In practice the register holds teas and rice, silks and ikats, metal and stone crafts, sweets and liquors.

Collective

A GI belongs to a community of producers, not to one firm. Applicants are associations of producers or bodies set up by law to represent them.

Tied to origin

The link between place and quality must be shown in the application, through natural and human factors, the production method and a map of the territory.

Public in character

A registered GI cannot be assigned or transferred. It is treated as public property, which keeps it with the community.

The legal framework

India protects GIs through a standalone statute: the Geographical Indications of Goods (Registration and Protection) Act, 1999 (Act 48 of 1999). It received assent on 30 December 1999 and came into force on 15 September 2003. It was enacted to meet India's obligations under the WTO TRIPS Agreement, and the Rules of 2002 supply the forms and procedure.

ProvisionWhat it says
RegistryThe Geographical Indications Registry sits in Chennai under the Controller General of Patents, Designs and Trade Marks (DPIIT, Ministry of Commerce and Industry).
Register, Parts A and BPart A records the registered GIs. Part B records registered authorised users.
Term (s.18)Ten years, renewable repeatedly. A lapsed registration can still be renewed if the application is filed within six months of expiry.
Authorised users (s.17)Producers who want to use a registered GI commercially register separately as authorised users, using Form GI-3. Their registration runs to the earlier of ten years or the GI's own expiry.
What cannot be registered (s.9)Names that have become generic, names that are not protected or have fallen out of use in their country of origin, and indications that are literally true but falsely suggest another origin.
Relation to trade marksA trade mark that conflicts with a registered GI is barred. Under s.26(4), action against a trade mark is cut off five years after the GI holder or user learned of the infringing use.
RemediesInfringement attracts the same remedies as trade mark infringement. Falsifying a GI is also a punishable offence.
Additional protection (s.22(2)-(3))The government may grant higher-level protection to "certain goods". The Act does not define that phrase and does not limit it to wines and spirits.

How a product gets registered

Applications go to the Registry in Chennai on Form GI-1. The government fee is ₹5,000 per class of goods, and the whole route typically takes 12 to 24 months.

  1. FileA producers' association or statutory body files Form GI-1 with the statement of case, map and list of producers.₹5,000 per class
  2. Scrutiny and examinationAn examiner checks for defects, and a consultative group of subject experts tests the claimed link between place and quality.Defects fixed within 1 month
  3. Show-causeIf the Registrar objects, the applicant answers in writing or asks for a hearing.2 months to reply
  4. JournalAccepted applications are advertised in the Geographical Indications Journal.Within 3 months of acceptance
  5. OppositionAnyone may oppose on Form GI-2. The applicant files a counter-statement or the application is treated as abandoned.3 months (+1 on request); 2 months to counter
  6. RegistrationIf there is no opposition, or it fails, the GI is registered and a certificate issues. Producers then apply as authorised users.Valid 10 years

Several guides name the Intellectual Property Appellate Board as the appeals body. That board was wound up in 2021 and its work moved to the High Courts, so check the current forum before relying on an older guide.

The numbers

The reference lists 684 registered GI entries as on 31 December 2025.[1] Handicrafts are the largest group at 375 entries, ahead of agricultural goods (225). Counts rise as new GIs are registered, so a figure for a later date will be higher.

Reading the counts

These are entries, not unique products. A logo registration is listed separately from its word mark, for example Kutch Embroidery and Kutch Embroidery (Logo), and a few GIs are shared across states. The Registry's own list is the authoritative record.

What GIs do for producers

Government material claims GI recognition can raise rural artisans' incomes by 20 to 30 per cent, citing the Ministry of Textiles. The number of authorised users reportedly grew from 365 to about 29,000 by January 2025. Leading export destinations include the UK, Italy, the UAE, Bahrain, Qatar, the US and South Korea.

Market access

Railway GI booths under One Station One Product, PM Ekta Malls and GI Trails give producers direct sales channels.

Exports

APEDA backs GI agricultural exports with quality work and overseas promotion. Karnataka GI fruit sent to the Maldives reportedly earned farmers 40 to 50 per cent more.

Target

India has set a goal of 10,000 GI registrations by 2030, and GIs now feature in trade negotiations.

Limits

Recognition alone does not lift income. One summary of the policy material says it has to be linked to retail platforms, e-commerce, tourism and exports. The income figures above come from official statements rather than independent studies.

Disputes and enforcement

Basmati and the European Union

India applied to the EU for protected GI status for basmati in 2018. Pakistan sought its own GI in January 2024, and the EU republished that application in April 2024. India rejected the EU's push for a joint application because Pakistan's filing includes Indian regions, which India says raises a sovereignty issue. Nepal has also objected to India's application. Recent reports say EU officials may treat basmati as generic, which would remove the protection India is seeking. Those reports are early and unconfirmed. The dispute is tied to the India-EU trade talks, including reciprocal protection for EU wines and spirits.

Cases that shaped the law

CaseWhat happenedWhy it matters
Pochampally weavers v. "HYCO Pochampally" (2005)Weavers' cooperatives sued over power-loom sarees sold under a similar-sounding brand. An interim injunction was granted and the case later settled. The first infringement suit under the 1999 Act.
Tea Board v. ITC Ltd (Calcutta High Court, 20 April 2011)The Tea Board objected to the hotel lounge name "Darjeeling Lounge". The court ruled for ITC.The GI Act protects goods, not services. A GI cannot be used to claim the word for everything.
Rasgulla: Odisha and West BengalTwo states each hold GI entries for their versions of the sweet.Shows that similar products can hold separate, place-specific GIs.

Some secondary sources date the Tea Board v. ITC judgment to 2019. The court's own text is dated 20 April 2011.

India's position in international rules

TRIPS Article 22 gives every product a standard level of GI protection. Article 23 gives wines and spirits a higher level that does not require proof that the public is misled. Since the Doha round began in 2001 the TRIPS Council has debated extending Article 23 to all products, with no consensus. India is among the developing countries pressing for extension, since Basmati and Darjeeling hold only the weaker standard abroad. At home India's Act already allows higher protection for goods the government specifies, under s.22(2).
